Terms of Use

Please read these Terms of Use (“Terms”) carefully before using the ValidEmailChecker website, located at www.validemailchecker.com (the “Site”), which is operated by ValidEmailChecker (“we”, “us”, or “our”). These Terms form a binding agreement between you and ValidEmailChecker and govern your use of the Site, including our core email validation services, as well as additional tools and features made available through the Site now or in the future (collectively, the “Services”).

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you must refrain from using the Services.

These Terms may be updated from time to time. When changes are made, we will revise the “Effective” date at the top of this page and may also notify you by email or by posting an announcement directly on the Site if the updates significantly affect your rights. Your continued use of the Services following such updates indicates your acceptance of the revised Terms.

How We Manage Your Uploaded Files

At ValidEmailChecker, we recognize the importance of safeguarding the email data you upload while using our Services. You retain full ownership of the email addresses, files, and any related information you submit for validation purposes (“Uploaded Data”). We do not sell, share, or disclose this data to third parties under any circumstances.

Your Uploaded Data may be accessed by our internal systems or support team strictly for the purpose of customer service, issue resolution, accuracy monitoring, or ongoing platform improvement. These efforts are designed to help us deliver a reliable and efficient validation experience to all users.

If you wish to remove your Uploaded Data from our system at any time, you have the ability to do so directly through your user dashboard. In addition, all validated files are automatically deleted after fifteen (15) days, unless you choose to delete them sooner. We are committed to maintaining both transparency and control when it comes to how your data is managed within our platform.

 Accounts

When you register for an account with ValidEmailChecker, you confirm that you are at least eighteen (18) years of age and legally permitted to enter into a binding agreement. You agree that all information you provide in connection with your account will be accurate, complete, and kept current at all times. Submitting false or outdated information may result in the suspension or termination of your account.

As a user of our platform, you are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree not to share your password or access with others, and to notify us immediately at support@validemailchecker.com if you become aware of any unauthorized use or security breach. Although team accounts are not currently supported, we may introduce shared-access features in the future. For now, each account is intended for use by a single individual only.

We reserve the right, at our sole discretion, to suspend or terminate any account for any reason, including but not limited to violations of these Terms, suspicious activity, or misuse of the Services. We also reserve the right to remove content, cancel tasks, or restrict access to features if necessary to protect our platform and its users.

Staying Informed About Your Account

When you create an account with ValidEmailChecker, you agree to receive email communications from us, which may include newsletters, product updates, promotional offers, and announcements about new features or services. These communications are intended to help you get the most out of your experience on our platform.

You are welcome to opt out of receiving promotional or marketing emails at any time. Each marketing email we send includes an unsubscribe link, and you can also update your preferences through your account settings. Choosing to unsubscribe will not affect your access to our core services.

However, even if you opt out of marketing emails, you will still receive essential communications related to your account. These may include password reset instructions, billing confirmations, account notices, and important system updates. These service-related messages are necessary for maintaining your account and fulfilling the core functionality of the Services.

Credits and Purchases

ValidEmailChecker offers credit-based access to our email validation services. One credit entitles you to validate one email address through the platform. Credits do not expire, and once a purchase is confirmed, credits are applied to your account immediately—only after successful payment processing.

All credit purchases are considered final and non-refundable. However, in the rare event that a service malfunction occurs on our end—such as a failed validation where credits were deducted in error—we will investigate the issue. If we determine that the problem originated from our platform, we may reissue credits to your account as a courtesy and at our discretion.

Payments made through the Site are securely processed by third-party providers. At present, we accept payments via PayPro Global for standard payment methods and Cryptomus for cryptocurrency transactions. By submitting your payment information, you authorize us to transmit that information to our payment processors, subject to our Privacy Policy.

You confirm that you have the legal right to use the payment method you provide, and that all billing information submitted is accurate and complete. We reserve the right to delay, withhold, or cancel any credit order if payment fails, appears fraudulent, or contains pricing or processing errors. Similarly, we may reject or suspend any transaction that we believe violates these Terms or our system integrity.

Use Restrictions

By using the ValidEmailChecker platform and its associated Services, you agree to comply with all applicable laws and to use the platform only for lawful and authorized purposes. You may not use the Services to validate email addresses that you do not have the legal right to possess, including lists that were acquired through scraping, purchased in bulk from unverified sources, or obtained without the recipients’ consent.

You are strictly prohibited from using ValidEmailChecker or any of its tools to send unsolicited communications, engage in spam-related activities, or carry out phishing attempts. The Services may not be used in connection with harassing, abusive, threatening, or fraudulent behavior, nor may they be used in any way that violates the privacy, rights, or safety of any individual or group.

Attempts to decompile, reverse engineer, modify, or otherwise gain unauthorized access to any portion of the platform, its source code, or underlying systems are expressly forbidden. This includes bypassing rate limits, probing system vulnerabilities, or using unauthorized automation to access our endpoints.

You are not permitted to scrape, collect, or harvest data from the Site or from other users through automated tools, bots, or scripts. Any activity that interferes with the integrity, availability, or performance of the Services may result in immediate suspension of your account and potential legal action.

Use of the ValidEmailChecker platform in violation of these Terms may result in account termination and loss of access to credits or features, at our sole discretion.

Availability, Modifications, and Limitations

At ValidEmailChecker, we strive to provide accurate, timely, and reliable information across our platform. However, our site and services are continuously evolving, and it is possible that some information presented on the Site may contain typographical errors, omissions, outdated content, or other inaccuracies.

We make regular efforts to update our product descriptions, pricing details, tool availability, and documentation. Nonetheless, we do not warrant that every element of the Site is error-free, complete, or current at all times. You acknowledge and agree that any reliance placed on such information is done at your own risk.

From time to time, we may correct errors, revise service descriptions, update pricing, or make other changes without advance notice. These updates may happen in real-time or be reflected after the fact. We reserve the right to make such changes at our sole discretion and without obligation to notify users individually.

For critical decisions involving pricing, compliance, or technical implementation, we recommend contacting our support team directly to confirm the most accurate and up-to-date information available.

Promotions, Bonus Credits, and Coupons

From time to time, ValidEmailChecker may offer promotional incentives such as bonus credits, coupon codes, introductory discounts, referral rewards, or future giveaways. These offers are designed to enhance your experience and may be available to both new and existing users depending on the promotion.

Currently, we include bonus credits with certain credit plans by default. These bonuses are clearly displayed during checkout and are automatically applied upon purchase. We reserve the right to modify, suspend, or discontinue any promotional offer at our sole discretion, including changing bonus amounts or adjusting eligibility without prior notice.

Unless otherwise specified, all promotions are subject to the terms outlined in this document. If a future promotion includes additional terms—such as usage limits or expiration dates—those terms will supplement and, in the event of a conflict, override the relevant portion of these Terms.

Participation in any future coupons, contests, or incentive programs implies acceptance of both these Terms and any additional instructions included in the promotional materials.

Your Uploaded Content: Rights and Responsibilities

ValidEmailChecker allows users to interact with our platform by uploading data, submitting content, or sharing information—whether privately for service use (such as email list uploads) or publicly through features like reviews, comments, or suggestions.

Your Responsibility and Ownership

You retain ownership of any content or data you submit to ValidEmailChecker, including email lists uploaded for validation. However, by submitting such content, you grant us a non-exclusive, royalty-free, and worldwide license to access, store, analyze, or use that content for purposes such as service delivery, customer support, troubleshooting, performance optimization, or feature improvement.

You are solely responsible for ensuring that the content you provide is lawful, does not infringe on any intellectual property or privacy rights, and complies with all applicable laws. You agree that you have the full legal right and authority to upload and use the content you submit through our platform.

Our Rights Regarding Submitted Content

ValidEmailChecker does not actively monitor all user-submitted content, but we reserve the right (without obligation) to review, remove, restrict, or edit content that:

  • Violates these Terms of Use,
  • Breaches applicable laws or regulations,
  • Infringes on intellectual property,
  • Contains offensive, misleading, or harmful material, or
  • Poses a risk to our platform or other users.

If such content is identified, we may take action including removing the material, disabling accounts, or initiating legal steps if necessary.

Liability for User Content

We are not responsible for the legality, accuracy, or integrity of content submitted by users. Any reliance on such content is at your own risk. Additionally, by using our services, you agree not to upload, post, or transmit any content that you do not have the right to share or that is unlawful, harmful, or in violation of third-party rights.

Repeat violations or the submission of malicious, copyrighted, or misleading content may result in permanent suspension of your account.

Intellectual Property and Brand Protection

At ValidEmailChecker, we take intellectual property seriously—not just ours, but yours too. All materials, features, designs, tools, and branding associated with ValidEmailChecker are protected by copyright, trademark, and other intellectual property laws applicable in Canada, the EU, and other jurisdictions.

Our Ownership of the Platform

Everything you see or interact with on our website—including our logo, graphics, service descriptions, custom-built tools, and the layout of our pages—is the property of ValidEmailChecker or used under proper license. This includes both our paid and free tools such as the Email Generator, SPF/DKIM/DMARC Record Tools, and Signature Generator.

We grant you a limited, non-exclusive, non-transferable license to use our services for their intended purposes. This license does not give you permission to copy, modify, distribute, reproduce, or publicly display any portion of our platform without prior written permission from us.

Use of Our Brand Assets

Unless explicitly authorized in writing, you may not use the ValidEmailChecker name, logo, domain, or design elements for any marketing, advertising, or commercial purposes—especially in a way that might imply endorsement or partnership.

However, if you are a partner, affiliate, or featured client, we may use your logo or company name in our promotional materials, including on our website and newsletters. You can opt out of this inclusion at any time by contacting us at support@validemailchecker.com.

Respecting Third-Party Rights

If you believe that content hosted on our site infringes your intellectual property rights, you can notify us directly. We’ll review all valid claims and, where appropriate, remove the infringing material in compliance with applicable IP protection laws.

External Links and Third-Party Content

While using ValidEmailChecker, you may come across links to other websites—such as our payment processors, documentation, analytics platforms, or email service providers. These links are provided for your convenience or to support core functionality on our platform.

Third-Party Services We Rely On

We currently work with trusted third-party platforms including:

  • PayPro Global – our official payment processor
  • Cryptomus – for handling cryptocurrency payments
  • Google Analytics and Microsoft Bing Ads – for tracking performance and improving user experience
  • Cloudflare – for security, CDN, and performance optimization

Although we’ve selected these providers based on their reliability and privacy practices, these platforms operate under their own privacy policies and terms. When you interact with any of these services—whether you’re making a payment or viewing embedded analytics—you are subject to their terms, not ours.

We’re Not Responsible for External Websites

Please note that ValidEmailChecker does not control or take responsibility for the content, accuracy, or practices of third-party websites or services linked from our platform. We cannot guarantee that these external sources are free from errors, malware, or offensive content.

Your interaction with any third-party service, whether through links on our site or as part of using our services, is entirely at your own discretion and risk. We strongly recommend reading their privacy policies and terms of service before submitting any personal or payment information.

If you find a link on our website that you believe is broken or potentially harmful, please notify us immediately at support@validemailchecker.com.

Account Termination and Service Suspension

At ValidEmailChecker, we reserve the right to terminate or suspend your account if we believe that your use of the platform violates our Terms of Use, poses a security risk, or interferes with the integrity of our services.

When and Why We Might Suspend or Terminate Access

We may suspend or permanently terminate your account, with or without prior notice, if:

  • You breach any part of our Terms or abuse our services
  • You use the platform to validate email addresses you do not have the legal right to process
  • You attempt to circumvent security measures, spam the platform, or misuse available tools
  • Your actions cause harm to other users, our infrastructure, or third parties

This action may be taken at our sole discretion to protect the security, fairness, and availability of ValidEmailChecker for all users.

What Happens If Your Account Is Terminated?

Termination of your account means your access to our services will be immediately disabled, including any email verification credits, stored files, or in-progress tasks. We may retain certain information as required by law or to resolve disputes, but we will no longer provide access to your account dashboard or data stored within your user profile.

If you believe your account was terminated in error, you may contact us at support@validemailchecker.com or through our contact page. We’ll review the case and respond appropriately, though we are not obligated to restore access if Terms were violated.

Survival of Terms

Certain provisions of these Terms will continue to apply even after your account has been terminated. These include, but are not limited to: ownership rights, limitation of liability, intellectual property clauses, and any provisions that by their nature must survive to give them effect.

Legal Responsibilities and Third-Party Claims

When You May Be Held Accountable

By using ValidEmailChecker, you agree to take full responsibility for how you use our platform. If your actions—intentional or accidental—result in a legal claim, dispute, or financial loss against us, you agree to step in and shield us from that burden. This is called “indemnification.”

This means if your use of our email validation services causes harm to another user, breaches someone’s privacy, violates a law, or infringes upon intellectual property rights, and that leads to a complaint or lawsuit against us, you will be required to cover the resulting costs. These may include attorney fees, court costs, penalties, or damages.

What This Covers

This obligation to defend and compensate us applies to claims made by third parties due to:

  • Your use or misuse of our platform
  • Violations of our Terms of Use
  • Any content you upload, transmit, or otherwise make available via our services
  • Any unauthorized use of another individual’s data
  • Any breach of laws or rights of another person

Essentially, you agree that we should not be held liable for actions that result from your behavior. This indemnity extends to our team, including employees, contractors, partners, officers, and affiliates.

Why This Clause Matters

Indemnification protects the integrity and sustainability of ValidEmailChecker. It ensures that every user contributes to maintaining a safe and responsible environment by standing behind their actions and respecting legal boundaries.

Limitations on Our Legal Responsibility

What We’re Not Liable For

At ValidEmailChecker, we do our best to offer reliable, secure, and high-performing services. However, there are some things we simply cannot guarantee, and we want to be transparent about those limitations.

By using our services, you agree that ValidEmailChecker—and any of our partners, employees, or service providers—cannot be held responsible for any indirect, incidental, or consequential damages. This includes financial losses such as lost profits, lost business opportunities, or damage to your brand reputation that might result from using our platform.

For example, if your email list experiences delivery issues, or if there’s a temporary disruption to our site that affects your operations, we are not liable for the consequences.

Specific Scenarios We Cannot Cover

This limitation applies to any issue that might arise due to:

  • Service interruptions or downtime
  • Inaccurate validation results
  • Data loss or corruption
  • Unauthorized access to your account
  • Mistakes in content, pricing, or promotions on our site
  • Third-party services we integrate with (like PayPro Global, Cryptomus, Google Analytics, or Cloudflare)

In short, we provide our services “as is” and “as available,” without guaranteeing uninterrupted functionality, error-free performance, or outcomes that meet your expectations 100% of the time.

Reasonable Expectations

While we strive to prevent problems, technical errors and unforeseen issues can occasionally occur. By agreeing to these terms, you acknowledge that ValidEmailChecker is not liable for any resulting losses—even if we were aware a problem could happen.

This clause is important because it helps us maintain a sustainable platform while continuing to invest in security, support, and feature improvements.

Disclaimer of Warranties

Services Are Provided “As Is”

At ValidEmailChecker, we work hard to offer an accurate and dependable service. However, like any online service, we cannot make absolute guarantees about how our tools and features will perform in every circumstance.

When you use our platform, you accept that all services—including our email validator and free tools like SPF, DKIM, DMARC generators and checkers—are provided strictly “as is” and “as available.” This means we do not guarantee that the services will always work flawlessly or meet every expectation you may have.

No Implied Warranties

We do not offer any implied warranties. This includes—but is not limited to—warranties of:

  • Merchantability: We don’t promise that our services will meet a certain standard of commercial quality.
  • Fitness for a Particular Purpose: We don’t guarantee that our tools will meet your specific business or legal needs.
  • Non-infringement: We don’t claim our services are guaranteed to be free of third-party claims or intellectual property issues.

We Don’t Guarantee the Following

By using ValidEmailChecker, you agree that we do not promise:

  • That our services will be available without interruption at all times
  • That our results will be 100% free of errors
  • That our platform is completely secure from all threats
  • That the results from our services will lead to successful outcomes (e.g., 100% email deliverability)

We use industry-leading technologies like Cloudflare and perform routine maintenance to enhance security and performance. However, no digital service is perfect, and there may be occasional disruptions, errors, or delays beyond our control.

Your Responsibility

It’s your responsibility to evaluate the results and effectiveness of our services in the context of your own business goals. While we aim to assist your email marketing efforts and reduce bounce rates, we can’t make guarantees regarding the results you’ll achieve.

Exclusions

Where Some Rules May Not Apply

While ValidEmailChecker is committed to being transparent and fair, it’s important to note that some of the disclaimers and limitations outlined in the previous sections may not apply to everyone.

Certain regions—especially those with strong consumer protection laws—may not allow us to exclude implied warranties or limit liability for incidental or consequential damages. In those cases, the rules outlined in our “Disclaimer of Warranties” and “Limitation of Liability” sections may not fully apply to you.

Your Local Laws Take Precedence

If your jurisdiction provides you with specific legal rights that override some parts of our Terms, those legal rights will remain intact. This means:

  • You may still have warranty protections under local consumer laws.
  • You may still be entitled to certain forms of compensation or legal recourse.

In such cases, ValidEmailChecker’s Terms will apply only to the extent permitted by your local laws.

We Respect Local Legal Protections

Our goal is to provide a useful service that complies with applicable laws. If any provision of these Terms is found to be invalid or unenforceable in your jurisdiction, the rest of the agreement will remain in full effect.

What Law Applies to These Terms

These Terms of Use—and any disputes or claims arising out of or relating to them—are governed by the laws of the Province of Ontario and the laws of Canada, without regard to conflict of law principles that might apply to a different jurisdiction’s laws.

Where Disputes Will Be Handled

If a legal dispute arises between you and ValidEmailChecker, you agree that such matters will be resolved exclusively in the courts of Ontario, Canada. By using our Services, you consent to the jurisdiction of these courts and waive any objections to their venue.

International Users and Compliance

While we proudly serve users around the world, we do not guarantee that our Services are compliant with the laws of jurisdictions outside of Canada. It is your responsibility to ensure that your use of ValidEmailChecker complies with local laws applicable to you.
